1. About Peony & Mulberry

2. About these terms

These Terms & Conditions apply to purchases made from Peony & Mulberry through our online store.

Please read them together with our Privacy Policy, Shipping & Delivery Policy and Returns & Refunds Policy.

Nothing in these Terms limits or excludes any statutory rights you have as a consumer.

3. Products

We take reasonable care to ensure that product descriptions, photographs, dimensions, materials, colours and other information shown on our website are accurate.

Colours may appear slightly different depending on your screen and device.

Products made from natural materials may have variations in colour, texture, weave or finish. These natural characteristics are not faults where they are inherent in the material and do not affect the product's conformity with its description or applicable legal standards.

Product availability may change and we may discontinue products from time to time.

4. Prices and payment

The price payable for your order will be shown at checkout before you place your order.

Peony & Mulberry Ltd is currently not registered for UK VAT and does not charge UK VAT on its sales.

For international customers, prices and charges may vary by destination to account for matters such as local taxes, duties, currency conversion and cross-border costs.

Where applicable, these will be shown through the international checkout before you place your order.

Payment must be successfully authorised before we dispatch an order.

5. Placing an order and forming a contract

When you submit an order, you are offering to purchase the products in your basket.

An automated acknowledgement that we have received your order does not by itself mean that we have accepted it.

Our acceptance of your order, and the contract between you and Peony & Mulberry Ltd, takes place when we send you confirmation that your order has been dispatched.

If we cannot accept your order, for example because an item is unavailable, payment has not been authorised, there is an obvious pricing or description error, or we reasonably suspect fraud or unlawful activity, we will let you know.

If payment has already been taken for an order that we do not accept, we will refund the relevant amount.

6. Delivery

Our delivery options and further information are set out in our Shipping & Delivery Policy.

For in-stock mainland UK orders, we normally aim to dispatch within 1–2 working days.

Delivery estimates are estimates unless we expressly agree a guaranteed delivery date with you.

7. International orders

We sell to eligible international destinations.

International orders may be facilitated through Shopify Managed Markets and international commerce partners such as Global-e.

Available products, currencies, delivery services, taxes, duties and other charges may vary according to destination.

Where supported, applicable international taxes, duties and cross-border charges are incorporated into the international checkout pricing.

Certain products or destinations may be unavailable because of legal, customs, carrier or product restrictions.

8. Your right to cancel and return an order

Your cancellation and return rights are explained fully in our Returns & Refunds Policy.

Where the statutory cancellation right applies to an online purchase, you generally have 14 days after receiving the goods to tell us that you wish to cancel. You must then return the goods within the applicable statutory period.

For an ordinary change-of-mind return, you are responsible for the direct cost of returning the goods where our Returns & Refunds Policy states this and the law permits it.

You should take reasonable care of products while deciding whether to keep them. Where handling beyond what is reasonably necessary to establish the nature, characteristics and functioning of an item reduces its value, we may make a deduction where permitted by law.

9. Hygiene-sensitive products

Certain sealed goods may not be suitable for return for health-protection or hygiene reasons.

Where a silk eye or face mask, or another hygiene-sensitive product, is supplied with an appropriate hygiene seal, the statutory change-of-mind cancellation right may not apply once that seal has been broken.

This does not affect your rights where a product is faulty, damaged, misdescribed or otherwise does not conform to the contract.

10. Faulty, damaged or incorrect products

Products supplied by Peony & Mulberry must meet the standards required by applicable consumer law.

If you receive an item that is faulty, damaged, incorrect or not as described, please contact us as soon as reasonably possible.

We may request photographs or other reasonable information to help us investigate the issue.

Nothing in these Terms limits or excludes any statutory remedy available to you in relation to goods that do not conform to the contract.

11. Promotions and discount codes

Promotions and discount codes may be subject to additional conditions displayed with the relevant offer.

Unless otherwise stated, discount codes have no cash value and cannot be combined with another promotional code.

If we identify an obvious error in a promotion, we may correct or withdraw it, subject to applicable consumer law and any contract already formed.

12. Intellectual property

Unless otherwise stated, the Peony & Mulberry name, branding, original photographs, designs, written content and other original website content belong to Peony & Mulberry Ltd or are used by us under licence or with permission.

You may browse and use our website for personal, non-commercial purposes.

You must not reproduce or commercially exploit protected Peony & Mulberry content without our permission except where permitted by law.

13. Reviews and customer content

If you submit a product review or other content to our website, it must be genuine and must not be unlawful, misleading, defamatory, abusive or infringe another person's rights.

We may moderate or remove content where reasonably necessary.

We do not knowingly publish or commission fake consumer reviews.

14. Third-party services

Our website uses third-party services to operate functions such as ecommerce, payments, delivery and international checkout.

Those providers may have their own applicable terms and privacy policies.

Our Privacy Policy explains how personal information is handled in connection with our store and service providers.

15. Our responsibility to you

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or liability that cannot otherwise lawfully be excluded.

If we breach these Terms, we are responsible for loss or damage that is a foreseeable consequence of our breach or our failure to use reasonable care and skill.

We supply our consumer products for private and domestic use. We are not responsible for business losses arising from use of products purchased as a consumer, to the extent permitted by law.

17. Changes to these Terms

We may update these Terms from time to time, for example to reflect changes to our business, services or applicable law.

The Terms applying to your purchase will normally be those in force when you place your order, subject to any rights or requirements imposed by law.

18. Governing law and disputes

These Terms are governed by the laws of England and Wales.

If you live elsewhere, you may also benefit from mandatory consumer protections provided by the law of your country or part of the United Kingdom. Nothing in these Terms removes those protections or any mandatory right you may have regarding where proceedings can be brought.
